BREAKING: Reports of Noncitizens Detained Boarding DOMESTIC Flights, Despite Pending Applications

We are currently vetting reports of foreign nationals being detained at multiple U.S. airports while boarding domestic flights, despite having timely filed, pending immigration applications.

One reported case involved an individual whose L-1 status had expired while a Form I-485, Adjustment of Status application, remained pending.

As a general rule, a timely filed Adjustment of Status application permits an applicant to remain in the United States while the application is pending, even after the underlying nonimmigrant status expires. Advance Parole generally applies to international travel, not domestic flights within the United States.

These reports are concerning, particularly given the current immigration enforcement environment. We are continuing to verify the circumstances and will provide updates as more reliable information becomes available.
